This company sells psychedelic tea and gummy bears. We’re pretty sure it’s not legal

Yes, Leafland. You read that right.

At this very moment, a California company called Psilouette is about to send you psilocybin teas and edible gummies. All you have to do is return the favor with a gift of financial reward. If you like, a donation.

Psilouette’s website offers a variety of gummies in varying dosages, from the super small Acclimate dose (250 micrograms) to the claimed libido-boosting aphrodisiac stack (500 micrograms) and the full Enthogen dose (2,000 micrograms).

To put these dosages in perspective, 10 milligrams of psilocybin is considered a low dose. 35 milligrams is considered a high dose. 2,000 micrograms equal 2 milligrams. So, Psilouette’s highest-dose gummy (per single gummy) contains a relatively low dose of 2 milligrams of psilocybin.

Does the whole thing sound legal to you? Well, the company’s founder wouldn’t argue with that.

Read on to learn more about Psilouette’s online ordering policy, how the company views its own legal status, and what we think of the products themselves.

What is inside?

First, let’s get something clear. These gummies contain real, unadulterated psilocybin. No Amanita Muscaria. No synthetic psilocybin. The only true.

Psilouette founder Derek Chase is a former corporate associate of Johnson & Johnson who also runs CBD wellness company Flora & Bast.

He told Leafly that he currently sources the mushrooms from California.

Psilouette currently uses “natural flavors”, honey, tapioca syrup, pectin, and other ingredients to create a pleasantly chewy gum that tastes like a mild starburst… with no hint of mushroom bitterness. Chase says they hope to switch from the “natural flavors” to a passion fruit and mango puree. But I have to say, they taste damn good.

A friend and I have both tried the Acclimate dose. Although it offered a chill experience that lasted for a couple of hours, we both felt it lacked the sativa-like zing that many consumers, myself included, associate with microdosing.

The Acclimate dose contains the equivalent of 0.25 milligrams of psilocybin. To be honest, I’m a bit surprised that each of us could feel anything at such a low dose. But – at least in our sample size of two people – the dose was definitely noticeable.

A gift, then a donation

Although the Psilouette website states that their gummies are “available in legal markets nationwide,” Chase told Leafly they will ship them “basically everywhere” in the United States.

He further noted that individuals do not pay the company directly in exchange for gummies. Instead, after placing an order, you will receive an email with a donation suggestion.

“No one gets charged when they check out,” Chase told Leafly.

In a separate interview with Beauty Independent, Chase said that between 85% and 90% of people who place an order go through with the suggested donation.

“We don’t worry if people can’t afford it, if people don’t want to pay… It’s still very margin-enhancing at this point,” he explained in the interview.

nope And don’t take it from us.

“Technically, nothing we do is legal,” Chase told Leafly.

“We are well aware that this violates what the DEA would consider legal,” he added.

His justification for providing the shrooms seemed to hinge on a belief that banning psilocybin itself is illegal. “From a constitutional standpoint, drug planning is completely illegal,” Chase said.

Chase said he recognizes that Psilouette could face legal action for breaking the law. “We don’t think they could punish us for that in the long run, but they could try and they could be successful,” he told Leafly. “But we believe the company’s mission keeps us in a less risky state because so many marketers out there are doing the same thing, but in less responsible ways.”

As for personal possession of these gummies, it depends on where you live. Oregon and Colorado have both effectively decriminalized possession. Oregon launched its therapeutic psilocybin program earlier this month, and Colorado lawmakers are currently writing rules for their own program.

Additionally, more than a dozen municipalities across the country — including Seattle, San Francisco, Oakland, and Detroit — have effectively decriminalized possession of psychedelic substances.

The company is developing quickly

Chase hinted that the company’s business model could change in the near future. They could require a consultation to send one person their produce, he said, and they could also limit the number of people they supply shrooms.

“We can shut it down for new consumers and treat our current consumers offline,” Chase said. “It’s hard enough as it is.”

Chase also noted that he hopes to license and operate a service center in Oregon through a separate LLC to manufacture legal psilocybin. “We don’t really talk about Psilouette in the same breath as the Oregon business,” he said.
