America’s millions of consumers of CBD and other hemp-derived medicines face a dizzying array of new products and regulations this July in the United States. Entrepreneurs are working to make money while regulators have started protecting public health. The drummer from The Grateful Dead has a new line of CBD. The FDA is warning Delta-8 manufacturers to phase it out with counterfeit packaging.

On July 5, the FDA issued warning letters to manufacturers of counterfeit snack foods containing delta-8-THC — a risk of poisoning. Manufacturers incorporated Delta-8 into packaging of similar Doritos, Cheetos, and Oreos. In the past two years, more than 1,000 children have been poisoned by D-8 products, and one has died. The Drug Enforcement Administration proposed a plan in May to drastically limit the amount of THC allowed in CBD products and destroy the Delta-8 market. At a conference in Houston, ill-named DEA chief Terrence Boos announced that the agency would propose adding hemp-derived cannabinoids to the controlled substances list. He said the agency also wants to lower the allowable THC content in CBD products from 0.3% to 0.1%. Sellers have taken advantage of the 0.3% limit to ship intoxicating hemp products.

What’s with all the Delta-8 these days?

CBD products exploded thanks to the 2018 farm bill that legalized hemp. CBD bathed in an acid can form delta-8-THC, which differs by one atom from delta-9-THC. Delta-9 THC remains banned in most states, so this Delta-8 loophole in hemp legalization has sparked a multi-billion dollar hemp oil rush as entrepreneurs try to meet Americans’ high demand for a cessation.

Update on federal legalization of hemp and hemp-derived cannabinoids

US Senators Jon Tester (D-MT) and Mike Braun (R-IN) introduced legislation in March to remove many testing regulations surrounding industrial hemp. Proponents hope this would make it easier to expand hemp cultivation for non-extraction uses like fiber, seeds, or hempcrete.

Legislative updates for novel cannabinoids from state to state

The Alabama The House of Representatives has passed a bill that would criminalize the sale of delta-8-THC and other hemp-derived cannabinoids to anyone under the age of 21. The bill passed the state Senate in February. As of this writing, Gov. Kay Ivey (R) has yet to sign the bill into law.

In April, Arkansas Gov. Sarah Huckabee-Sanders (R) signed Law 629 banning the sale of hemp-derived cannabinoids. For adults, it comes into force on August 1st. For minors, it came into effect immediately.

On May 22nd Montana Gov. Greg Gianforte (R) signed into law a bill banning the manufacture and sale of Delta-8 and other hemp-derived cannabinoids. It came into effect immediately.

On May 19th Tennessee Gov. Bill Lee (R) signed a bill regulating the state’s hemp-derived cannabinoids market — including a 6% sales tax — and prohibiting sales to minors. It came into force on July 1st.

VermontThe United States Cannabis Control Board ruled in late April that only dispensaries can sell cannabinoids derived from hemp. Not surprisingly, confusion arose.
