The Illinois Supreme Court says the smell of cannabis justifies a vehicle search without a warrant
In a recent decision, the Illinois Supreme Court ruled that the odor of raw cannabis constitutes probable cause for law enforcement to conduct a vehicle search without a warrant. This ruling contrasts with a previous ruling in which the court found that the smell of burnt cannabis alone did not justify such searches.
The case in question involved a traffic stop in Whiteside County in 2020, during which a trooper detected the odor of fresh cannabis emanating from a vehicle. While searching the car, the officer discovered several rolled joints and a container containing suspected cannabis. The passenger, Vincent Molina, attempted to suppress the evidence, arguing that the mere smell of raw cannabis was not sufficient grounds for the search. However, the Illinois Supreme Court disagreed, finding that the smell of raw cannabis combined with other factors could constitute probable cause.
This decision departs from the court's September 2024 decision, which found that the smell of burnt cannabis alone does not constitute probable cause for a vehicle search. Judge Mary K. O'Brien, who dissented in the recent case, noted that this distinction “defies logic” and highlighted the complexity of legal interpretations following the legalization of cannabis in Illinois.
While Illinois law allows adults to possess and consume cannabis, there are strict regulations surrounding its transportation. Cannabis must be stored in a sealed, odor-proof, child-proof container that is reasonably inaccessible during vehicle movement. Failure to follow these guidelines may result in legal consequences, as demonstrated by the court's recent ruling.
