The Costa Rican Supreme Court approves cannabis legalization, now comes the political battle

In a unique game, Costa Rica has taken a huge step closer to legalizing its home cannabis trade. The Costa Rican legislature referred the unresolved cannabis reform to its highest court in late October. And on December 1, 2021, Sala IV, the Act of the Constitutional Court, found that nothing in the law could prevent the bill from being implemented. Now the ball is back with the legislature and it’s time to play.

This news is certainly a big step for Costa Rica. The bill is called the Law on Cannabis for Medical and Therapeutic Purposes and Hemp for Industrial Use, which was originally approved on October 21, 2021. At that time, 33 votes against 13 received approval for the second round of voting. Instead of the bill for a second vote, however, more politics came into play. A parliamentary group of 10 MPs sent the pending bill to the Constitutional Chamber of the Supreme Court. This was done to get a valid review and basically to block general passage of the bill.

In general, many believe that Costa Rican lawmakers originally backed cannabis legalization thanks to Panama’s pro-cannabis influence. This is because Panama, Costa Rica’s neighbor to the south, legalized the medicinal use of cannabis a day before Costa Rica’s important decision.

The legalization law, which is ready for the second round of voting, is designed to give local and small cannabis producers an economic boost. Farmers are said to receive 40% of the licenses published by the Ministry of Livestock and Agriculture. Regardless, the use of cannabis for recreational purposes would still be prohibited.

What’s the next step for Costa Rica?

Following the court ruling, lawmaker Zoila Volio asked for more information. President Carlos Alvarado made an effort statement to the legislative assembly. In fact, the Minister of the Presidency, Geannina Dinarte, has already made some public announcements. She announced that the bill would be publicly called to an extraordinary session after the court ruling was passed. Reform has undoubtedly taken some time (around two years now), but the moment is closer than ever. So far, so good; only one organization is allowed to study and study the viability of cannabis.

A chain of reactions should be set in motion.

The second ballot will decide whether or not the medicinal use of cannabis will be legalized in Costa Rica. If the vote is positive, the project is approved. All that remains is the signature of President Carlos Alvarado and a publication from the Official Gazette La Gaceta. Then the bill will come into force.

The bill provides for the free production, cultivation, commercialization and industrialization of hemp and its by-products. Farmers can produce without additional government approval.
