
Richter in Texas allows Delta 8 products to be legally sold – for now
In the ongoing saga of Delta-8 THC sales in Texas, a Travis County District Court judge overturned an injunction on legal Delta-8 sales on Monday. That effectively makes the sale of Delta 8 THC products nationwide legal – at least until a lawsuit on the matter is fully heard in early 2022.
This particular fight began in January 2021 when the Texas Dept. of State Health Services stated that Delta-8-THC is an illegal substance across the state.
That ruling was challenged by Hometown Hero, an Austin-based maker of hemp products, some of which contain Delta-8 THC. Austin is in Travis County.

The Houston Chronicle today published the judge’s full judgment on the injunction.
