New York State – Latest Delta 8 THC Ban – Latest cannabis news today

If you like Delta 8 THC products, then you should stock up as they can be a lot harder to find. Last week, New York State agreed to ban products containing Delta 8 THC. New York is the seventeenth state to ban Delta 8 THC, which is a massive blow to the CBD market.

It’s a worrying trend that appears to be growing and the effects will extend beyond national borders. The call to ban Delta 8 is gaining momentum and will affect all of North America. From the latest developments to the effects, here is a look at the legal situation relating to Delta 8 THC.

What is Delta-8-THC?

Delta 8 THC is an incredible cannabinoid with untapped therapeutic potential. While we don’t know much about it, we do know that Delta 8 THC can help with nausea, anxiety, depression, and pain. While it may have some molecular similarities to Delta 9 THC, it’s a completely different cannabinoid and nowhere near as psychoactive. Harvest Delta 8

Until recently, Delta 8 THC was not available because it was too difficult to harvest. It comes in very small amounts, of course, but it can be converted from either CBD or Delta 9 THC. The process is all about extraction and conversion. The first step is to extract cannabinoids from herbal raw material. Once the CBD or Delta 9 THC is separated, the concentrate is processed and refined to transform its atomic composition. The process requires the use of chemical solvents and these are flushed as the final step. When done correctly, laboratory tests prove that the end results are safe.

Hemp loophole

In most cases, hemp is the most common source of Delta 9 and there are several reasons for this:

  1. Legally, there is less bureaucracy around hemp production. There are fewer licenses, application fees, and bureaucratic requirements for working with hemp as opposed to THC.
  2. Due to the lack of THC, most if not all of this state’s cannabis regulations do not apply to the final Delta 8 product. When extracted from hemp, Delta 8 THC fits into a very interesting legal loophole that allows for international export.

So if this cannabinoid is so useful and can’t get you high, what exactly is the problem? The problem lies in the production process; it creates two specific problems:

  1. The production of Delta 8 THC is technically legal, but legislators fear that consumers will not be protected. Technically, manufacturers can avoid any government-prescribed quality control and sell the product without legal obstacles.
  2. Due to the atomic conversion, Delta 8 THC is classified as a synthetic cannabinoid. It involves chemically altering other molecules – it’s a designer drug. This puts Delta 8 THC in a completely different classification than natural cannabinoids. It’s a gray area that many want to avoid.

Delta 8 THC ban

If no Delta 9 THC is involved, cannabis regulations need not apply unless the product is prohibited. As it turns out, many states have chosen this path. Florida creates a legal framework for Delta 8 THC. On July 19, 2021, New York passed a ban on synthetic cannabinoids, and that includes Delta 8 THC.

Currently, Delta 8 is banned or restricted in Alaska, Arizona, Arkansas, Colorado, Delaware, Kentucky, Idaho, Iowa, Michigan, Mississippi, Montana, New York, North Dakota, Rhode Island, Utah, Vermont, and Washington.

The effects

The United States is a major manufacturer and importer of many of the Delta 8 THC products available in Canada. As more states move to banning Delta 8 THC, Canadian consumers can expect supply problems. The medical cannabis community will be hardest hit by this, but hopefully those hardest hit will find a suitable replacement.
