Luxembourg legalizes adult personal cannabis cultivation, but you cannot sell it or ship it to someone else

These are certainly exciting times for the cannabis industry as the gradual transition from prohibition to legalization is gradually taking on a global shape. Gone are the days when many were criticized and stereotyped for enjoying the natural herb’s recreational quality. The current state of affairs has created a welcoming environment for anyone and everyone to harness the herb’s potential for medicinal and relaxing benefits. The by-product of this is that more countries are now open to legalizing its cultivation and use within their jurisdiction. The last country to join the party is Luxembourg, which has legalized the production and use of cannabis.

For those very familiar with the trend in cannabis laws across Europe, you will agree that this step is very important in changing the scope of cannabis laws across Europe. Luxembourg is the first in Europe after announcing that it will legalize the production and consumption of natural herbs. Under the new legislation, people over the age of 18 will be legally allowed to grow up to four cannabis plants in gardens and homes. The cannabis plants grown in such households can be used personally if the law also allows the herb to be consumed.

The government’s announcement touched on other important topics of conversation surrounding the use of cannabis products in the country. One of these discussion points has to do with the trading of natural herb seeds. The new law will allow traders and traders to trade seeds while lifting any restrictions on quantity or THC content. This means that it will be possible to import cannabis seeds, buy them in stores or order them online. There is also a belief that this announcement will increase domestic production of seeds and strengthen the country’s national production and distribution chain.

The coast is still not entirely clear in terms of the ban

However, it is important to note that this new legislation by the Luxembourg government still has some restrictions. Some activities with the natural herb are still forbidden under the new law. These activities include the use and transportation of cannabis and its products in public places. Likewise, the trade in cannabis or cannabis products other than its seeds remains prohibited and punishable.

Some of the criminal provisions for crimes related to cannabis or cannabis products have been relaxed, while others remain unchanged. The consumption and transport of cannabis up to 3 grams are now chalked as an offense that is softer than the previous classification as a criminal offense. The fines for possessing cannabis under 3 grams are still £ 25, which is far from £ 251. However, the punishment for possessing and transporting cannabis products over 3 grams continues as usual.

Benefits for the people and the government of Luxembourg

One of the main talking points of this new government announcement is what it wants to achieve with the move. The previous approach taken by the Luxembourg government aimed to discourage its citizens from using the natural herb for recreational purposes. This move did not bring much profitable outcome, however, as the existing trend showed that more citizens were indulging in using the herb. Therefore, the move to legalize the herb is intended to help the government curb the effects of the originally flourishing black markets. It will also help the government advocate and promote sensible use of the herb.

The government intends to use this legislation to regulate the system of production and distribution of cannabis and cannabis products in order to authenticate product quality. The government is also said to have plans to introduce revenue from the sale of cannabis into comprehensive public education about the herb and health care. This puts the state in a prime position to protect its citizens from the threat of counterfeit and contaminated products common in illegal markets. So it is only a matter of time before the state wins the war against illegal black markets with the advent of this new law.

Impact on the rest of Europe and the world

As we have already mentioned, this step by the government is the first of any country in Europe, which makes it the pacemaker of this step among the countries of the continent. This step is all the more monumental when you consider the resolution of the UN Convention on the Control of Narcotic Drugs. The signatories agreed that the manufacture, import, export, distribution, trade and possession of pharmaceuticals would be limited to medical and scientific purposes. This includes cannabis, but Luxembourg joins Canada, Uruguay and 11 US states that have now disregarded this resolution.

The future of cannabis legislation in Europe is very promising, but it is still far from what cannabis enthusiasts have hoped for. The Netherlands are still considered to be one of the nations in Europe that are more relaxed about cannabis laws. However, activities such as recreational use, possession and trade are still classified as illegal. What exists in the Netherlands is a greater tolerance towards recreational use of cannabis within set limits, which is very different from full legislation. The UK is also sticking to this stance as the possession, distribution, cultivation and use of cannabis remain banned, with a fine and possible jail time for those who default.

Bring away

While it is good news that the Luxembourg government has taken this bold step, it is important not to get carried away just yet. These are still the early days and much remains to be done if full legalization for recreational and medical purposes is to be achieved in all European countries. Nevertheless, we can celebrate this current victory and its significance for the Luxembourgers.
