At the federal level, Delta 8 has been a legal strain of hemp since the Hemp Growing Act was passed in 2018 that made it legal to grow hemp containing 0.3% or less Delta 9 THC. This opened the doors for scientists, chemists, and engineers to develop new strains of THC and extract the small amounts of Delta 8 from the plant to highlight and reinforce their role within the high.

Since there are still many legal gray areas in America when it comes to cannabis and legality, Delta 8 THC is not legal in all 50 states, although it is legal at the federal level.
