Delta 8 Cars and Gummy Bears Now Have NFTs (April D-8 Newsletter)

Hello and welcome back to the Leafly Delta 8 THC newsletter.

Users consider Delta-8 “marijuana light” – it differs only slightly from Delta-9 THC, which remains banned in most states. But due to a loophole in hemp legalization, hemp-derived CBD chemically converted to Delta-8 is legal in many marijuana-banned states. This has sparked a multi-billion dollar hemp oil frenzy as the industry scrambles to meet Americans’ high demand for the high.

Is delta-8-THC still legal in your state or even county? What does science say about safety? What are consumers saying? Delta 8 news appears daily as regulators try to keep up with new products being legalized alongside hemp. What about Delta-10, THC-O, or other novel cannabinoids synthesized from the CBD in hemp?

the Alternative Products Exhibition Promoters held an event at Ft. Lauderdale, FL, March 11-13. The ad boasted of learning from “50+ expert speakers on all aspects of Delta8, CBD/hemp and other alternative products”! as one of the main attractions. [Altproexpo.com]

A Reddit user thinks using Delta-8 gave them one foot fetish. “Felt really weird and fell asleep because of it. When I woke up, I had the strongest need for feet, and I’ve never been a foot person before.” [Reddit]

Capitol Hill lawmakers didn’t move any D-8 legislation in March.

State News

the Georgia The Senate returned a hemp bill to committee after lawmakers noticed language that would have inadvertently legalized Delta-8. [AJC]

controller inside Illinois issued a policy statement preventing licensed cannabis companies from manufacturing delta-8 or delta-9 THC using hemp oil. [via Marijuana Moment]

Kansas The Attorney General has issued a statement stating that delta-8-THC is legal only when derived from hemp. Products containing it must not exceed 0.3% total THC. [via Marijuana Moment]

in the Kentucky, the Senate Agriculture Committee approved a bill banning Delta-8. At the end of the month, Senator Paul Hornback, who sponsored the law, after consulting with supporters of the state’s hemp industry, urged lawmakers to withhold the law while amending it to only ban sales to those under the age of 21. How does Delta-10 compare to Delta-8 and THC?

Minnesota Regulators voted to allow small amounts of THC in over-the-counter hemp products. According to lobbyist and activist Kurtis Hanna, this decision finally allows the state pharmacy board to buy and own Delta-8, Delta-10, and CBD, although the sale must be regulated by lawmakers at a later date. A bill introduced Tennessee would further limit the allowable delta-8 THC level to 0.3%. [Fox17 Nashville]

Utah Legislators banned smokable hemp and the incorporation of CBD into edibles, leaving it to federal agencies instead, but Delta-8 managed to get away with it. The ban specifically excludes “any cannabinoid intentionally produced through a process of converting one cannabinoid into another,” which is how delta-8-THC is normally produced. Virginia Lawmakers passed a complicated measure that redefined marijuana to regulate the sale of Delta-8. It was rewritten to broaden the definition of marijuana to include any substance that contains a total THC concentration greater than 0.3%, including delta-8 and other related cannabinoids. Cannabis farmers are concerned that hemp-derived cannabinoids are hurting their businesses and how states are individually addressing the issue. “It will make our farm obsolete,” Griffis, the True North Collective’s chief operating officer, previously testified Michigan’s Marijuana Regulatory Agency recently. “The roughly $3 million I invested…will be wiped out.” [Associated Press]

In Gwinnett County, Georgia, a judge issued one injunction against the public prosecutor, which prevents him from prosecuting anyone for the sale or possession of Delta 8 and Delta 10 products. “I have concerns that this may or may not be a renegade prosecutor,” said Fulton County Superior Court Judge Schwall. “I think some prosecutorial priorities are misplaced.” [Associated Press]

celebrities Tennessee Democrats have roasted state Republicans on Twitter for trying to ban Delta-8. Rep. Gloria Johnson said, “We just keep going backwards, we need to keep Delta 8 legal and move forward with cannabis reform!” [@VoteGloria]

The sheriff in Catoosa County, Georgia sent letters to local retailers telling them they had tested products labeled as containing delta-8 only to find that they had “an illegal amount of delta-9-THC, the psychoactive ingredient in cannabis products, that induces a ‘high’”. Stores have until the end of the month to remove the products and that the sheriff has “evidence needed to proceed with the prosecution and seizure.” [News Channel 9 ABC]

Indiana lawmakers spared Delta-8 this year but promised a settlement in Year 23. “The DEA (Drug Enforcement Administration) on this issue says if it’s won naturally, it’s legal; If it’s synthetically made, it’s illegal,” Senator Michael Young said. “The problem is our police departments, we cannot say which is naturally derived or that have been made synthetically.” [Indiana Public Media]
