A federal judge in Oklahoma rules gun bans on cannabis users unconstitutional
A federal law that bans persons who use marijuana from owning firearms has been ruled unconstitutional by a federal judge in Oklahoma. Judge Patrick Wyrick, an appointee to former President Donald Trump, ruled in favor of a man charged in August with violating the ban, saying it violated his right to bear arms.
Wyrick stressed that while the government can prevent dangerous individuals from possessing firearms, it cannot restrict a person’s fundamental rights based solely on their status as a marijuana user. He also pointed out that the drug is legal for medical use in Oklahoma and several other states.
In his ruling, Wyrick stated that marijuana use does not reflect violent or threatening behavior and is not consistent with the nation’s historic firearms regulations. Public Defender representing the accused, Laura Deskin, hailed the decision as a positive step in giving more Americans the right to bear arms.
The US Department of Justice has not yet commented on the decision but is expected to appeal. This ruling follows the June ruling by the conservative majority of the US Supreme Court, which stated that the Second Amendment protects a person’s right to carry a handgun in public for self-defense. This new test of gun laws has been cited by other courts when they ruled similar regulations unconstitutional. The U.S. 5th Circuit Court of Appeals also on Thursday ruled unconstitutional a federal law that bans persons engaged in domestic violence from owning firearms.
This brings us one step closer to the ideal; “I want my gay married friends to defend their marijuana plants with guns…”
This “joke statement” is consistent with the anarchist or libertarian approach to governance, where the individual has supreme authority over their mind and body.
Of course, the state is likely to appeal…but every time there’s such a legal victory, we get closer to the day when we can drive the final nail in the coffin of the war on drugs.
I thought I was done writing on this subject 10 years ago…it turns out that in 2023…the war on drugs is still as real as ever!
It’s good news, folks! We’re making strides, and while it can feel a little overwhelming at times, cannabis will eventually escape the shackles of prohibition… and society would be better off for it.
The road to legalization may be long, but every victory is a step forward, and we must continue to fight for the rights of individuals and their right to use marijuana without fear of losing other rights and freedoms. The war on drugs may not be over yet, but the tide is turning and the future looks brighter.
