The FDA finally moves cannabis research and regulation forward: Hiring a former cannabis policy regulator in New York

The FDA has named Norman Birenbaum as its senior public health advisor for cannabis research and regulatory action, reports Inside Health Policy.

Why this matters

This is the first time the FDA has hired a cannabis research and regulatory consultant. The agency continues to struggle with regulations for marijuana-based products, including those containing only CBD.

Despite the passage of the 2018 Farm Bill that repealed hemp and gave the FDA the power to monitor hemp-derived products, the agency has since sought additional safety data, leading it to ban CBD in foods and dietary supplements.

The appointment of Birenbaum, former director of New York State’s cannabis program, signals more action and commitment from the FDA on cannabis issues.

In May, the agency announced that Deputy Chief Commissioner Janet Woodcock will chair the agency’s Cannabis Products Council, which oversees marijuana product policy, enforcement and public relations.

Who is Birenbaum?

Birenbaum previously served on the staff of Senator Elizabeth Warren (D-MA) and served as chief cannabis policy adviser to the governors of New York and Rhode Island, leading the marijuana regulatory agencies in both states.

Former New York Governor Andrew Cuomo (D) hired Birenbaum as state director of cannabis programs two years ago. During his tenure, Birenbaum helped pass the Marijuana Regulation and Taxation Act (MRTA) in 2021, which legalized cannabis.

Before joining the Cuomo administration, Birenbaum founded the Rhode Island Office of Cannabis Regulation, which manages the state’s medical marijuana and industrial hemp programs while supporting former Gov. Gina Raimondo Efforts to legalize recreational cannabis.

Birenbaum is the founding president of the Cannabis Regulators Association (CANNRA), whose members represent the leading marijuana regulators from 43 states and US territories, Throckmorton wrote.
