New York regulators allow medicinal cannabis patients to grow their own cannabis

On Thursday, the New York Cannabis Control Board (CCB) voted for an ordinance that would allow certified patients to grow up to six cannabis plants for their own therapeutic use.

According to the Marihuana Regulation & Taxation Act (MRTA) passed in 2021, home cultivation of medical cannabis is allowed for patients aged 21 and over in the state medical cannabis program.

Likewise, certain caregivers who care for patients under the age of 21 (or who are unable to cultivate themselves) may cultivate on behalf of the patient.

Landlords retain the option to prohibit tenants from growing on their land.

After a 60-day public comment period from the rules posted, the board will review the comments, make any necessary revisions, and officially submit the rules for them to take effect.

According to Tremaine Wright, chairwoman of the CCB, “home growing medical cannabis certified patients will be an inexpensive way to obtain cannabis through personal cultivation,” reported Marijuana Moment.

Extinction

At the Thursday afternoon meeting, the Office of Cannabis Management announced efforts to delete cannabis records.

To date, there have been 45 deletions in marijuana-related cases, Marijuana Moment wrote, although most remain “in custody or custody for additional crimes”.

A slide presentation at the meeting showed that “approximately 203,000 marijuana-related charges are currently being suppressed from background searches and are currently being sealed or deleted,” the slides read. “This will add to the roughly 198,000 seals that were carried out as part of the first round of marijuana deletions for the 2019 deletion legislation.”
